FORMS, FEES, AND INSTRUCTIONS

Forms for Fictitious Business Name Statements, Statements of Abandonment of Use of Fictitious Business Name, and Statements of Withdrawal from Partnership Operating Under Fictitious Business Name are available at the Nevada County Recorder’s Office and local Chambers of Commerce.

Instructions on completing the forms are printed on the reverse side of every form. The fee for filing each form is $24. Each additional partner or owner name costs $2, and each additional Fictitious Business Name at the same location costs $5.

If you are submitting your form and paying fees at our office, note that we accept cash, checks, and ATM/debit cards.

Please review carefully the information on your form. It is the sole responsibility of the filer to assure the accuracy of the information.

After you have paid the fees and the Fictitious Business Name Statement has been filed in the Nevada County Recorder’s Office, you will receive three certified copies: one for your files, one to submit to a general circulation newspaper for publication (if necessary), and one to submit to your bank or other financial institution (if necessary). You will receive two certified copies of a Statement of Abandonment of Use of Fictitious Business Name or Statement of Withdrawal from Partnership Operating Under Fictitious Business Name: one for your files, and one to submit to a general circulation newspaper for publication.

FICTITIOUS BUSINESS NAME STATEMENT PUBLICATION

California Business and Professions Code Section 17917 requires that the filer of a new Fictitious Business Name Statement, or renewal Fictitious Business Name Statement that contains changes, shall cause it to be published in a local newspaper of general circulation in the county where the principal place of business is located. It is the responsibility of the filer to determine if publication of a renewal Fictitious Business Name is necessary. Publication must be done once a week for four successive weeks, beginning within 30 days after filing and concluding within 28 days of the first publication date. The Recorder’s Office must receive proof of publication (called an affidavit of publication) within 30 days of the final publication date.

The affidavit of publication should be forwarded from the newspaper to the Recorder’s Office; however, the filer should assume responsibility to ensure the affidavit is mailed in a timely manner and the Recorder’s Office receives the affidavit of publication from the newspaper within 30 days after the completion of the publication.
FBN ABANDONMENT OR WITHDRAWAL OF PARTNERSHIP PUBLICATION
