Proposition 64

Proposition 64 is also known as the Adult Use of Marijuana Act. It was passed by the voters in November of 2016. However, please be aware that the possession, use and/or sale of cannabis is still illegal under Federal Law.

What is Legal


  • Possession, processing, transportation, purchasing, obtaining, or giving away without compensation to adults of less than a ounce (28.5g) of marijuana (HSC11362.1(a)(1))
  • Possession, processing, transportation, purchasing, obtaining, or giving away without compensation to adults of less than 8 grams of concentrated cannabis (HSC11362.1(a)(2)
  • Possession, planting, cultivating, harvesting, drying, or processing of six marijuana plants or fewer
  • Smoking or ingesting marijuana or marijuana products
  • Possession, transportation, purchasing, obtaining, using, manufacturing, or giving away without compensation to adults marijuana accessories

What is Still Illegal


  • Synthetic cannabinoid compounds under HSC11357.5.
  • Being under the influence of marijuana while driving under VC23152(e)
  • Distributing marijuana to people under age 21
  • Using marijuana in public
  • Smoking marijuana where smoking tobacco is prohibited
  • Possessing marijuana on schools grounds while children are present
  • Using marijuana within 1,000 feet of a school while children are present
  • Having an open container of marijuana while in a vehicle, whether driver or passenger
  • Making hash oil/BHO without a license under HSC11379.6 per HSC11362.3(a)(6)
